This privacy policy applies to the processing of personal data in our mobile application "Handwriting & Old Letter Scanner AI".

2. Hosting

The hosting services used by us serve the provision of the following services: infrastructure and platform services, computing capacity, storage space, security services, and technical maintenance services that we use for the purpose of operating the app.

In doing so, we, or our hosting provider, process inventory data, contact data, content data, usage data, meta and communication data of users based on our legitimate interests in an efficient and secure provision of our app according to Art. 6 Para. 1 S. 1 lit. f GDPR in conjunction with Art. 28 GDPR.

The server locations are in data centers within the European Union (currently Germany and France).

3. Collection and Processing of Personal Data

a) Use of the App

When using our app, technical information is automatically processed (e.g., IP address, device type, operating system, date/time of use). This is technically necessary to display the app and to ensure stability and security.

Legal basis: Art. 6 Para. 1 S. 1 lit. f GDPR.

4. Storage Duration

Personal data is only stored as long as it is necessary to fulfill the purposes. Since no registration takes place and no purchases are made, no permanent user profiles are created.

To ensure secure operation and for abuse prevention, we store the IP address of the requesting terminal device in log files for a limited period. This data is deleted after 7 days at the latest, unless security-relevant reasons make longer storage necessary. Uploaded images are deleted immediately from our servers after the analysis is completed.

5. Your Rights (GDPR)

5.1 Right to Information (Art. 15 GDPR)

Information about whether and which personal data we process, including purposes, categories, recipients, storage duration, and a copy of the data.

5.2 Right to Rectification (Art. 16 GDPR)

Immediate correction of incorrect or completion of incomplete personal data.

5.3 Right to Erasure – "Right to be forgotten" (Art. 17 GDPR)

Deletion of your personal data, provided that the legal requirements are met. Exceptions only exist for compelling legal reasons or for legal prosecution.

5.4 Right to Restriction of Processing (Art. 18 GDPR)

Restriction of processing in certain cases (e.g., in the case of disputed data or unlawful processing).

5.5 Right to Data Portability (Art. 20 GDPR)

Receipt of the data provided by you in a structured, common, machine-readable format or transfer to another controller.

5.6 Right to Object (Art. 21 GDPR)

You have the right to object at any time, for reasons arising from your particular situation, to the processing of personal data concerning you, which we carry out on the basis of Art. 6 Para. 1 lit. e or f GDPR.

5.7 Right to Withdraw Consent (Art. 7 Para. 3 GDPR)

Withdrawal of given consents at any time with effect for the future.

5.8 Right to Lodge a Complaint with a Supervisory Authority (Art. 77 GDPR)

Complaint to a data protection authority, especially in the member state of your place of residence, workplace, or the alleged violation.

5.9 Right to Information (Art. 19 GDPR)

Notification of all recipients in the event of rectification, erasure, or restriction of processing, unless impossible or disproportionate.

5.10 Rights in Automated Decision-Making Including Profiling (Art. 22 GDPR)

Not to be subject to a decision based solely on automated processing, which produces legal effects or significantly affects you.

6. Data Security

We use technical and organizational measures to protect your data from unauthorized access, loss, or misuse. Data transmission is carried out via an SSL or TLS encrypted connection.

7. Swiss Data Protection Act (DSG)

This statement also takes into account the Swiss DSG (as of 01.09.2023), as far as we process data of persons in Switzerland.

8. Use of our Mobile App (Device Access)

When using the app, the data transmitted by the user is processed, in particular images required for using the functions. The app may require access to functions of your device (e.g., camera or photos). Access is only granted after your express consent.

9. Data Transfer to Third Countries

If data is transferred to providers outside the EU, this is done on the basis of legal requirements (e.g., standard contractual clauses). A residual risk from state access (especially in the USA) cannot be excluded.

10. AI-assisted Image Analysis

Our app enables the analysis of handwritten documents and historical letters using artificial intelligence.

User Consent (Art. 6 Para. 1 S. 1 lit. a GDPR):

When you use the analysis function, you decide for yourself which images you upload via the app. By actively uploading the image for analysis, you grant us your express consent to forward this image to our servers and the external AI service provider for processing. You can withdraw this consent at any time by deleting the app or not using the function (with effect for the future).

Details of processing:
The images are transmitted via our servers to an external AI service (Google Ireland Limited) for analysis. Processing is carried out on the basis of a Data Processing Agreement according to Art. 28 GDPR. The images are processed exclusively for the purpose of analysis. According to our current knowledge, the data is not used for training the AI models. It cannot be excluded that the transmitted images are processed on servers outside the EU (especially USA). In these cases, the transmission takes place on the basis of suitable guarantees (standard contractual clauses according to Art. 46 GDPR). We do not have full influence on the data processing by the AI service used. Permanent storage of the images by us does not occur.

11. Technical Processing of AI Scans

The images transmitted within the framework of AI scans are processed via a securely encrypted connection (SSL/TLS) to our servers and forwarded to the AI service used to carry out the analysis. Permanent storage of these images by us does not occur. We have no influence on the storage by the AI service used.

12. Provision via App Stores

Our app is provided via third-party platforms: Apple App Store (Apple Distribution International Ltd., Ireland) and Google Play Store (Google Ireland Limited, Ireland). When downloading and installing the app, personal data may be processed by the respective provider. We have no influence on this data processing.

13. Final Provisions

This privacy policy is provided in several languages. In the event of contradictions or interpretation difficulties between the German version and a translation, the German version alone shall be authoritative.
